How to Get Away With Murder Recap 10/23/14: Season 1 Episode 5 “We’re Not Friends”

Tonight on ABC their gripping new drama How to Get Away with Murder starring Viola Davis continues with an all new Thursday October 23, season 1 episode 5 called, “We’re Not Friends.” On tonight’s episode Annalise [Viola Davis] defends a minor who shot and killed his father—a police officer. Meanwhile, Wes [Alfred Enoch] and Rebecca start to wonder what Annalise’s motives are; and Sam’s relationship with Lila continues to irritate his wife. Also: A flash-forward reveals what’s going on between Laurel and Frank and why he was calling her the night Sam died.

On the last episode, Annalise and her students uncovered a shocking truth while investigating the case of Marren Trudeau (Elizabeth Perkins), founder and CEO of a major brokerage firm, who had recently been arrested for insider trading. Tonight’s episode of How To Get Away With Murder begins with Annalise and her students in class, Laurel finally stands up for herself and argues with Annalise in front of everyone. After class Wes corners Annalise and demands to know when she is going to turn Lila’s phone over to the police. Annalise says she isn’t sure if they should turn the phone over at all – she is stalling because Lila’s phone has evidence on it that proves her husband Sam had an affair with her.

Annalise flashed back to confronting Sam about the pictures on Lila’s phone the night before, Sam promises her that he didn’t care about Lila and it was just sex. They wind up in a screaming match and Annalise orders him to get out. Bonnie listens in on their entire conversation at the bottom of the stairs.

Annalise and her students head to her office to meet with their next client, a teenager named Ryan shot and killed his abusive father, who happened to be a cop. Annalise says their only chance of winning this is by appealing to their juror’s emotions. They decide their best bet to get jurors that will feel sorry for Ryan is at juror selection to try for women and minorities who don’t trust the police.

Annalise and her students have their work cut out for them. After they select the jury, the opposing lawyer asks the judge to throw out Annalise’s argument that Ryan killed his father to protect his mother, who he had abused for many years. Since Annalise has technically no proof of the abuse, just Ryan’s mother’s testimony, the judge agrees to throw it out.

After court Frank invites Laurel to go out for lunch, and she is disgusted that their case just went down the toilet and he is worried about getting a sandwich. They all head back to Annalise’s office to regroup. Bonnie passes out pictures of the jurors and assigns each student a juror, and orders them to follow them and get to know them inside and out. Annalise tells them all to go home and study Ryan’s blog inside and out, because they need to find a way to enter it legally in to evidence.

Wes heads home, and Rebecca bangs on the door. She smelled pizza in his room and she is starving, she doesn’t want to go outside because everytime she does people scream that she is a “killer.” While she eats Wes’s food she mentions that Annalise called her to check up on her, and she know that they might not use Lila’s phone.

Annalise heads home and starts pounding drinks. She heads to Nate’s house and corners him in his dark driveway, he doesn’t want anything to do with her though. Nate is furious, he just got fired because someone told his boss that he was investigating Sam, he thinks it was Annalise but it was actually Bonnie. Before Nate heads in his house he informs Annalise she is “sleeping next to a killer,” and he lied too, the weekend Lila was murdered Sam wasn’t at Yale like he said he was.

Annalise calls Bonnie in to her office, she informs her that she knows how she got Rebecca’s confession tape, by ratting out Nate. Bonnie argues that she didn’t want to involve Annalise because she had enough on her plate, Annalise interrupts her and accuses her of protecting Sam, then tells her to get out of the office.

They head back to court, and the prosecution’s witnesses all insist that Ryan’s dad was madly in love with his mom and never would have hurt her. Connor messages one of the jurors on a gay sex app, and gets him to talk about the court case and sexts him that all cop killers should burn in hell. Annalise takes the messages to the judge and gets on of the biased jurors kicked off. Laurel is keeping track of the juror’s on her emotional score card, and she says they might have half of them now.

Ryan’s mom takes the stand and cries about how badly Ryan’s dad abused her, and credits Ryan with saving her life. Annalise’s students watch their jurors to see how they are reacting to her testimony. Their case hits a speed bump when the prosecution questions Ryan’s mom and points out that ryan shot his dad with his own gun, so if Ryan had his gun then his dad couldn’t have killed her so he wasn’t exactly protecting her.

It’s time for the closing arguments, Annalise takes the floor and pleads her case and reminds the jurors that this isn’t about evidence, it’s about humanity. The law students are certain they are going to love by the expressions on the jurors’ faces. Laurel refuses to let Ryan go to jail, she doesn’t think it is right. She slips one of the juror’s a piece of paper on jury nullification, which is the practice of choosing “not guilty” even though you know someone is guilty – just because it is unjust to make them pay for their crime. Frank catches her and is furious, he tells Annalise what one of her students did, but refuses to tell her which one. Annalise tells Frank to call the judge and tell him that their jury has been tampered with.

Everyone heads back to court, and the judge questions the jury, he wants to know if anyone has been contacted them about the case, the juror confesses that she found information on jury nullification. The judge declares a mistrial, after court Annalise has great news. She says that since they brought up the abuse testimony, the DA has decided to offer Ryan probation, community service, and counseling.

After court Annalise heads home, and Sam arrives. As soon as he walks in the foor Annalise demands to know if he was in Yale when Lila was murdered. Sam confesses that he skipped his lecture because Lila called him and said she was going to kill herself and was really upset, he looked all over for her and couldn’t find her though. Sam apologizes for lying and cheating, but he swears he didn’t kill her. Annalise says that Rebecca Sutter is on her way over so Sam can do a psych evaluation, she wants to figure out if Lila ever told Rebecca she was having sex with Sam.

Sam argues it is a bad idea, but it’s too late. Rebecca rings the doorbell, Sam takes her in to his office and questions her while Annalise watches on a camera. Rebecca doesn’t show any signs that she knows Sam was sleeping with Lila, but she insists that whoever the “old married guy” was that was sleeping with Lila is the person who killed her.

Laurel heads to Frank’s house and curses him out for not telling Annalise the truth that she is the one who tampered with the jury. Frank kisses her for a moment, and then she pushes him off from her and says she has a boyfriend and storms out. She goes straight to her boyfriend’s house to have sex with him.

Wes goes home and finds Rebecca’s apartment door wide open with the key in the lock. Rebecca calls him panicked, she is walking down the street. Rebecca says that “they are both in on it,” and she has to get out of town. She tells Wes to look at the wallpaper. Wes heads back to Annalise’s house and barges in to her bedroom, Annalise ass him what the hell he is doing there. He looks at the wallpaper, and realizes that the photos of the guy on Lila’s phone were taken in Annalise’s room. Sam is Lila’s boyfriend. Annalise is speechless.

Fast forward to present day – Laurel, Michaela, Connor, and Wes are still trying to get rid of Sam’s body. Laurel heads to Frank’s apartment in the middle of the night and reminds him that he said he would do anything for her – she takes the bloody trophy out of her bag and hands it to him.
