In tonight’s Law & Order SVU episode, tonight was ripped from the headlines for those who might want to turn away. It began with a very disorientated woman that got on the train. She was unsteady on her feet. She kept dropping her bag. There was also a kind man in the same car as her who helped her and he became her outcry witness.

She confessed that she might’ve been sexually assaulted. She got help afterwards. She got to the hospital. She did a rape kit. She even found additional help from a nurse. The nurse was kind. Too kind.

She began answering questions for the victim to the cops when they showed up. Only Captain Benson had to tell the nurse that she needed to hear Emily’s story from her.

It couldn’t be from information fed to her to get a more favorable outcome. Or else it wouldn’t hold in court. Its alright that Emily was disorientated. She was drug tested at the hospital. Her possibly getting slipped a date rape drug or deliberately overfed alcohol will unfortunately help with her case.

The most important thing is that Emily gets to tell her story. She won’t be able to heal without it and Benson knows that. She went back to Emily. She continued with questions. Emily met with a friend named Josh. She had two drinks that she’s aware of. They were both tequila.

Her memory is understandably foggy even without the drinks. There was trauma to deal with. There was also guilt because Emily did blame herself once sobriety began to return. She blamed herself for getting that drunk. She blamed herself for trusting Josh. She blamed herself for going off with three guys.

She doesn’t remember how that happened yet she was carrying all the unnecessary guilt of it. The worst thing was Benson wasn’t completely sure if they could press charges in this case.

The current laws in New York needed to be updated. They currently stand was if Emily wasn’t sure if she said no or not and if she wasn’t drugged or passed out – it could’ve been consensual.

Emily’s own recollection was that she didn’t recall saying no. It didn’t matter that she was drunk. There were plenty of college kids who skated on such charges because they claimed they were both drunk or that she consented without remembering it. This wasn’t the case. Benson got answers from one of the perps’ own mother.

The crime happened at her home. It showed that Joshua Berger admitted she was too out of it. His friends egged him on. They even got into the house before him so they knew she couldn’t consent when they gangraped her. Mrs. Berger thought she had raised her son to be better than that. Benson pointed out that she wasn’t going to live forever.

Josh getting away with his crime will only push him to keep doing it. It was clear it hadn’t been his idea. He had had a crush on Emily. His friends played into that so that they could assault her as well.

The video helped clarify things. The three men were later arrested. Carisi fought for remand. Their lawyer was quick to point out that she was drunk. Emily had about seven to eight drinks. She would go on to testify she thought the guys were safe because Josh was a friend. She didn’t know about his crush on her. Or that he felt friend-zoned by her. His cowardice was what ultimately made him do it. It was Scott’s arrogance, Daniel backing up his cousin, and them both pushing Josh to finally be “man enough” to take his shot that caused what happened.

If Josh had been braver, he wouldn’t have allowed those men to go into the house. He would’ve stood up for Emily. Though his cowardice was no excuse for rape. Him having feelings doesn’t excuse the fact that she had a right to her own body. She wasn’t interested in him that way. Either stop being her friend or move on!

These things should be simple and there weren’t. Benson met a jury consultant who warned her that she shouldn’t have gone to trial on this one. They should take a plea deal.

Benson ignored it because she likes to believe she’s fighting the good fight. Well, its been thirty years and a jury was still of the mindset that a drunk woman was asking for it. They couldn’t make a decision on Emily’s case. It was deemed a mistrial. Benson ran into her new friend and she convinced her to fight a different way if the first doesn’t work.

She arrested Josh’s mother for obstruction of justice. The woman was going to initially bury the evidence against her son so Benson put an innocent woman in jail to threaten her son. She did it by going behind ADA Carisi’s back.

She used his new second chair that she knew Carisi didn’t like. Carisi said that Hawkins was a rich kid that the working boy didn’t think would last in SVU. Benson on the other hand has gotten used to giving Carisi orders and he wasn’t going to use mob tactics to make a case while Hawkins would. They got Josh to flip. He took a plea deal. He admitted that Emily was passed out during the sexual assault.

And while it won them their case, Benson’s friendship with Carisi was pushed to its limit.
